TC Heartland LLC v. Kraft Foods Group Brands LLC, 581 U.S. ___ (2017), was a United States Supreme Court case concerning the venue in patent infringement lawsuits. While a prior Supreme Court ruling in 1957 had determined that patent infringement cases were to be tried in the state that the defendant was incorporated, subsequent changes to the Judiciary and Judicial Procedure in the United States Code by Congress and decisions made in the federal court system led courts to rule that infringement cases could be brought anywhere the defendant conducted business that was considered infringing. This enabled plaintiffs to forum shop for the court they would have the best chance in; the United States District Court for the Eastern District of Texas became the most popular court for such cases, and encouraged many non-practicing entities, so-called "patent trolls", to use this court to seek litigation and settlements from larger companies.
* The case to the Supreme Court specifically challenged if the amendments by Congress and decisions by federal court had altered the Supreme Court's 1957 decision. The Court rule unanimously in favor of the petitioner, upholding their 1957 decision that patent infringement cases must be heard in the district that the defendant is incorporated within, and the changes by Congress to the Code did not alter this stance.
