The term aggravated felony was created by the United States Congress as part of the Immigration and Nationality Act (INA) to define a special category of criminal offenses. The INA says that every person "convicted of an aggravated felony shall be considered to have been convicted of a particularly serious crime." Any alien, including any non-citizen national of the United States, who has been convicted of any aggravated felony is statutorily barred from obtaining U.S. citizenship. Any alien who has been convicted of any aggravated felony is statutorily barred from receiving a visa to the United States, and such alien is to be arrested and placed in removal proceedings if found within the country.When the aggravated felony was introduced in 1988, as a response to heightened concerns about drug abuse, it encompassed only murder and felony trafficking in drugs and/or firearms (but not long shotguns, long rifles, and/or ammunition of such legal weapons). Every conviction covered by the aggravated felony was manifestly a crime punishable by imprisonment for a term exceeding one year. The Antiterrorism and Effective Death Penalty Act of 1996 (AEDPA) and the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA) both tremendously expanded the aggravated felony list by adding great many more criminal convictions.
